Terms and Conditions

Contract

Booking Contract represents the entire agreement between the owner of Villa Calista, Opatija - Icici, Croatia and the Client and can be changed only in written form signed by both parties. Booking cannot be made until both parties sign the Booking Contract and the deposit or full payment has been received.

Payment

The owner is obliged to send his bank account information to the Client if he prefers a bank transfer payment within 24 hours from receipt of the Booking Contract. The Client shall pay a deposit of 30% of the total rental amount within 72 hours of sending the Booking Contract. The remaining balance is due 17 weeks before the rental period. If booking is within 17 weeks of the rental date, the entire contract price shall be paid within 72 hours of signing the Booking Contract. If any payment is not made within the times set forth herein, the owner will treat the contract as cancelled, and the usual refund terms shall apply.

Cancellation

All cancellations must be in written form and take effect on the date of receipt by owner. Cancellation policy: 1) on receipt of the cancellation letter 17 or more weeks before the rental period, the owner will refund the entire booking deposit, 2) on receipt of the cancellation letter 15 - 17 weeks before the rental period the charge will be 30% of the full amount of the rental, 3) on receipt of the cancellation letter 13 - 15 weeks before the rental periods the charge will be 70% of the full amount of the rental, 4) on receipt of the cancellation letter less than 13 weeks before the rental period the charge will be the full amount of the rental.

Client responsibility

Any loss or damage to the property will be charged to the Client, who is required to act in a responsible manner at all times. The owner reserves the absolute right to require any individual to vacate a property for disruptive behaviour, in which case there would be no refund of any rental payment.

Number of occupants

The owner reserves the right to refuse the entry or to eject the entire group if the number of persons exceeds the number stipulated in the contract.

Complaints

Should any problem occur with the property, the Client must immediately notify the owner or manager and should allow the owner or manager reasonable time to solve the problem. Failure to do so will avoid any claim following the rental period.

Changes or cancellation by owner

The owner has the right to modify or cancel this contract at any time when it is necessary as a result of a force majeure, or any other occurrence outside the control of the owner. In this case the owner will promptly refund all monies paid. The owner's liability will be limited to the refund of all monies paid and the owner is not responsible for any other damages.

Access

The property owner and maintenance workers are allowed reasonable access to the property, especially for urgent maintenance and inspection.

Commercial use

Commercial use of the villa is forbidden unless agreed prior to the booking and with special conditions.

Liability

The owner is not responsible for any event which is out of his control (weather, breakdown of some appliance, burglary, health, injury or death of any member of a booking party and so on).

Jurisdiction

The Booking Contract shall be governed by and construed and interpreted in accordance with the laws of the Republic of Croatia. The parties agree that any action or proceeding brought to enforce or otherwise arising out of or relating to this Agreement shall be commenced and maintained in any court located in Primorsko-Goranska County, Croatia.
